Well, the ATF is terrified of what they refer to as, using the popular propaganda term, “Ghost Gun”.
If you haven’t heard the term before, it’s basically politically charged street slang for a lawfully built personal firearm, that is NOT required to have traceable serial numbers.
(And yes, the ATF is tracing you. They are obsessed with tracing you. Don’t believe me? Drink a shot for every time the word “trace” is used in this proposed law. Wait don’t. You’ll die.)
In addition, the ATF is acting unlawfully by trying to redefine congressional laws, which is not their department and isn’t constitutional. ATF is an agency, it is not the Congress. Congress is our legislative branch. Congress, NOT THE ATF, creates and defines law. On this premise alone, this proposed law should be trashed. But since we are here…
With this law, the ATF seeks to:
• Redefine congressionally approved terms we’ve been using for decades – unlawfully. (They are NOT congress)
• Broaden their reach of already unconstitutional power
• Set more LEGAL PRECEDENCE for continued unlawful overreach. Drip, drip, drip.
• Increase red tape and paperwork for US citizens and manufacturers seeking to abide by the law
• Make more items illegal or heavily regulated
• Bloat the already over-extended judicial system with more laws they often don’t have the funds or man-power to enforce
• Require even further permanent record keeping and reporting (further strengthening the “soft” registry)
• And a whole lot more, folks!
All while using the unconstitutional firearms acts created through national propaganda fueled fear campaigns starting in the 1930’s which created dangerous & unconstitutional LEGAL PRECEDENCE then too. Nothing new under the sun, eh?
Plus, they shockingly don’t even know what some of the firearms they are referring to actually are, but more on that later…

But wait! Are “Ghost Guns” – er, privately made firearms – really lawful?
In America, it is legal to manufacture your own firearm AS LONG AS you are a law abiding citizen AND you do not sell that homemade firearm to another or, of course, give it to a felon. This has been the law for 100s of years.
In the new proposed ATF law, listed here in all it’s 40 pages of legalese and unprofessionaly politically charged & biased glory, the ATF seeks to totally redefine many important terms including “firearm”, “gunsmith”, “frame or receiver”, and many other terms… even the word “readily”.
This proposed law doesn’t just target personally made firearms, it also vastly beefs up the power of the ATF to be the executive, legislative, and judicial branches all in one agency. Fun, right? Who needs checks and balances anyway.

Before we go further, let’s be clear and brutally honest. Many think there isn’t a national gun registration currently. Well, it depends on your definition of registry. Would you consider requiring manufacturers and FFLs to keep permanent records of firearms sold, disposed of, or even given to others as, at the very least, a soft registry? Well. We have it.
But that isn’t enough for the ATF. They want more.
This law will, if passed, increase the level of markings, required record keeping, the amount of devices considered a firearm and in need of regulation, etc etc. And frankly, it’s a mess of paperwork and red tape for the already over extended ATF. This prevents them from doing their job where it might actually matter. Wherever that is…
In reality, our systems already in place have failed us over and over again. Constitutional spitting aside: If we simply had enforced the laws already on the books in a fair and consistent way, and actually kept the systems up to date (like the national background check system (NICS), it would have prevented most, if not all, of the sensationalized crimes making headlines. The SYSTEM is failing us. More laws will not and can not change this. The SYSTEM needs mending.
Alas, the government can’t even or won’t even do that. Instead, the gov & ATF both think spending precious time creating more arbitrary laws which further bloat our already burdened and failing system will help.
All with the wild assumption that laws prevent criminals from breaking the law…
If you take the time to read even the first few pages of this proposed law (it might cure your insomnia), you will see this proposed law littered with unprofessional, biased, and politically charged language, as well as ignorance of firearms themselves.
For example, the ATF references the AR-15 right next to the M-16 (“Ar-15/M-16”) implying they are the same type of gun AND references the AR-15 as a gun “…originally manufactured almost exclusively for military use”.
Any person with even a little expertise on firearms would know this to be completely false. The AR15 was crafted for the civilian market, and is a semi-auto. No military in the world has widely adopted it. In fact, I’m not aware of even one military or military branch in the world that has even minimally adopted it. Maybe they’re counting Joe-bob’s neighborhood watch…
The M-16 is NOT an Ar-15. An AR-15 is NOT an M-16.
But, apparently the ATF doesn’t even know that.
Comforting.
Lastly, the ATF is NOT a rule-making body. Congress are the lawmakers. The ATF is an agency built to enforce the many unconstitutional gun laws created starting in 1934.
Ironically, these laws were passed by pointing to a relatively small but highly sensationalized amount of fat cat gangster criminals the government indirectly (?) created during their bought with the also unconstitutional prohibition of alcohol at that time.
Sound familiar? Every major firearms act has been passed through fear mongering, wild exaggeration, and sensationalism.
Now, I’m completely for constitutionally sound law and order. But this isn’t it.
Every time we allow our government or its agencies to spit on the constitution and bill of rights in any of its categories, it causes a train wreck of negative, human rights abusing, overreaching repercussions spanning decades. Feel free to do your research and check me on this.

Thank you for taking the time to really look at this and consider, at the very least, the unlawful conduct of the ATF thinking they can bypass our checks and balance system. We do not and should not allow them to create the legal precedence for more of this unconstitutional lawmaking.

as you well stated… the New Laws (Rules, NOT Laws), are unable to be enforced as they, the ATF doesn’t have funding to do so. What is Really happening here, is allowing the ATF to TRUMP-Up (excuse the poor use of the word Trump), charges against Law-Abiding Citizens, when or if the catch you with such guns. This is to allow the ATF to single-out individuals that are outspoken, or have guns they deem as Non-Compliant. This is similar to the weaponization of the IRS seen Recently during the Obamination’s Leadership.
You can be charged for any and every reason, and EVERYONE can be made to look like a Criminal! Add a few well-timed Press Releases (AKA: Made-up Stories), and voila: Even you can be made to look like John Dillinger!

I belong to GOA ( Gun owners of America ) they like you are a no holds barred organization that fights in the court room and capital every day for the rights of all Americans. And not only gun rights but all rights that hinder the law abiding citizens in this country. They are a great organization to be a member of .Thank you for your straight talk about these issues and the fact that you don’t sugar Coat anything is outstanding. The far left in the white house is a snake in the grass ! They try to charm you with they’re smooth talk then crawl around behind you and strike when your not watching. (Snakes in the grass). Thank you Kirsten for this information. Your truly a great American . This type of illegal unconstitutional regulation by the ATF is far overreaching on our rights as US citizens. As a legal gun owner I vow to continue to fight for or freedoms and lawful rights . I urge every gun owner to contact their representatives and Senators to vote down any legislation that interferes with our 2nd amendment rights ❤️💪🏼🇺🇸
